PREAMBLE
This Personal Data Protection Policy, hereinafter referred to as the “Policy”, intends to inform you about the following points: 1 – The commitments adopted by Cocktail Team® regarding the Protection of Personal Data, under the terms and in accordance with the
Regulation (EU) 2016/679, on the protection of natural persons with regard to the processing of Personal Data and the free movement of such data. Such commitments are adopted based on the General Data Protection Regulation, hereinafter «RGPD»; and
2 – About the way in which Cocktail Team® treats your Personal Data, in particular Personal Data obtained digitally, namely through websites, applications or any other platforms.
1. DEFINITIONS
«Personal Data» – is any information related to the Data Subject and that allows him to identify
«Data Subject» – any identified or identifiable natural person to whom the Personal Data are associated. The natural person can be identifiable or identified, directly or indirectly, namely, through the name, civil or tax identification number, location data, online identifiers (such as IP addresses and logs). Identification can also be done through factors of physical, physiological, genetic, mental, economic, cultural or social identity. The user of the website, applications and digital platforms is considered the Data Subject in relation to Cocktail Team®.
«Controller» – Cocktail Team® internal entity that defines the purposes and means of Personal Data Processing. «Subcontractor» – entity external to Cocktail Team® that processes Personal Data on its behalf. «Processing» – any operation carried out within the scope of Personal Data, through automatic means or not, such as the collection, recording, organization, structuring, storage, adaptation or alteration, recovery, consultation, use, disclosure by transmission, dissemination or, alternatively, making available, harmonizing or associating, restricting, eliminating or destroying. Any other operation provided for under the terms of the RGPD is also considered Personal Data Processing.
2. WHAT COMMITMENTS DOES THE COCKTAIL TEAM® ASSUME IN RELATION TO THE PROTECTION OF PERSONAL DATA?
Cocktail Team® guarantees the complete protection of Personal Data in accordance with the rules provided for in the RGPD, with regard to all the procedures and obligations provided therein, especially with regard to the Processing of Personal Data of users of websites, applications and digital platforms (eg: visitors, customers, prospects, job seekers, etc.).
2.1. PERSONAL DATA PROTECTION
The Person Responsible for the Protection of Personal Data, under the terms of the RGPD and the internal policies adopted by Cocktail Team®, is responsible for informing and advising on the applicable requirements, as well as for monitoring compliance with said requirements and the way in which Cocktail Team acts. ®, cooperating and acting as preferred contact with the competent Supervisory Authorities.
2.2. PERSONAL DATA PROTECTION COMPLIANCE PROGRAM
Cocktail Team® developed and implemented tools and procedures with the objective of guaranteeing the effective protection of Personal Data. Cocktail Team® has adopted and implemented several internal policies and procedures with a view to raising the awareness of its employees, suppliers and partners about the protection of Personal Data, providing them with training and operational guidance on compliance with the RGPD, always monitoring compliance with these procedures . Cocktail Team® internally implemented a specific training program with the aim of raising awareness and training all its employees on these matters.
2.3. PERSONAL DATA PROTECTION PRINCIPLES
Processing of Personal Data
Cocktail Team® undertakes to treat your Personal Data in accordance with the following principles:
Your Personal Data is processed legally, impartially and transparently, thus guaranteeing the principles of legality, impartiality and transparency;
Your Personal Data are collected and processed for specific, explicit and legitimate purposes, and are not processed in a way that differs from and is incompatible with the purposes for which they were collected, thus guaranteeing the principle of purpose limitation;
Your Personal Data are collected and maintained adequate, relevant and limited to what is strictly necessary, taking into account the purposes for which they are processed, thus respecting the principle of data minimization.
Your Personal Data must be true and, whenever necessary or so understood, must be rectified and updated, thus respecting the principle of rigor.
Treatment Safety
Cocktail Team® has defined technical and procedural measures with a view to the effective implementation of the principles of Personal Data protection, in order to comply with the RGPD, thus protecting the rights, freedoms and guarantees of the Personal Data Holders, from the beginning of their collection and subsequent Treatment.
Cocktail Team® determined the imposition of the same level of protection of Personal Data to all Subcontractors (service providers, suppliers, partners, etc.) through the inclusion in contracts of specific clauses for this purpose.
3. INFORMATION RELATED TO THE PROCESSING OF PERSONAL DATA CARRIED OUT BY COCKTAIL TEAM®
3.1. HOW DOES COCKTAIL TEAM® COLLECT YOUR PERSONAL DATA?
Through the collection carried out in the commercial establishments that it operates and through its websites, applications and digital platforms in which the user makes available and consents to the respective collection.
Thus, it is possible for Cocktail Team® to collect your Personal Data through the following means:
In the commercial establishments it operates;
When you create a registration/account on one of your websites, applications or digital platforms;
When you browse Cocktail Team® websites, applications or digital platforms (i.e. technical information, such as IP addresses or logs, collected through cookies or similar technologies when authorized);
When you contact the customer support service by choosing the option to contact you back or, when you communicate with a Cocktail Team® customer service team and consent to the conservation of your Personal Data;
When you purchase items, products or services online;
When you subscribe to the newsletter provided by Cocktail Team®;
When you participate in a contest, marketing program, test or survey;
When applying for a job “Join Us” or on the dedicated recruitment website;
When you enter comments or images on social media pages owned by Cocktail Team®;
When, in any other way, you send us personal information and consent to its storage and processing;
3.2. WHY DOES COCKTAIL TEAM® NEED TO COLLECT YOUR PERSONAL DATA? Cocktail Team® collects your Personal Data for the following purposes: Recruitment
and Human Resources Management Cocktail Team® collects your Data for analysis and response applying for a particular job. In cases where there is no action by Cocktail Team® regarding the job application, the Personal Data will be kept in accordance with the provisions set out in section 3.4. In the event of recruitment, the Personal Data will be transferred to the competent Human Resources department in order to be processed for the respective purpose, in accordance with the principles indicated above and with the Human Resources policies.
Customer Relationship Management
Cocktail Team® collects Personal Data regarding business relationships with customers and potential customers and, in particular:
To allow you to purchase items, products and services, more specifically, to place orders online on Cocktail Team® websites, applications and digital platforms;
To provide you with after-sales services in connection with your orders or with items, products and services you have purchased;
To obtain your opinion on articles, products and services, in particular through surveys and tests;
To allow you to participate in contests, surveys or other marketing programs;
To establish statistical analyses, financial and commercial studies and for online traffic management purposes (eg: to obtain levels of use of the Cocktail Team® website, applications and digital platforms, as well as the relevance of the services made available as a means of to improve their usability);
For sending information or promotional communication and advertising from Cocktail Team® and/or other companies, in particular about products, campaigns and events that may be of interest to the customer, provided that (subject to your prior authorization, when necessary and respecting the your right of refusal in accordance with legal requirements applicable to direct marketing for commercial purposes).
These notifications can be sent by email or post or via mobile service (phone call, SMS and MMS).
Fight against fraud
Your Personal Data will be treated in such a way as to prevent situations of fraud on the part of third parties.
The Personal Data related to your order will be processed in order to guarantee a high level of security in carrying out the transaction in order to prevent identity theft and fraud in making payments. With the intention of combating fraud, payments made by credit card or any other means may be subject to audits by Cocktail Team®, through methods of automatic processing of information related to the order. Cocktail Team® may transfer your Personal Data to third parties, such as service providers or, when legally required, to public and/or judicial authorities. In case of outstanding balance, suspected fraud or attempted fraud, Personal Data will be preserved in an internal file until the situation is rectified. Under these conditions, Cocktail Team® may refuse any and all commercial transactions until the situation is rectified. When verifying situations similar to those described above, the customer will be informed individually and will have the possibility to comment and prove his identity.
Information considered mandatory is marked with an asterisk on the online forms available by Cocktail Team®. Without this information, the user’s request/order cannot be processed. Providing the remaining information is optional.
3.3 LEGAL BASIS OF PROCESSING
The Processing operations carried out in relation to the Personal Data of customers by Cocktail Team® are based on:
In your legitimate interest in making sales, protecting your activities, products and services, as well as better identifying your customers’ preferences as a way of customizing offers and highlighting items, products and/or services that best match your needs;
In the need to execute the contracts concluded with its customers for the sale of articles, products and/or services;
When the Treatment is required by the legislation in force; and
When explicit consent is acquired.
Cocktail Team® also has a legitimate interest in carrying out recruitment operations in order to manage its activities in the best possible way. In this sense, Cocktail Team® collects all the necessary data about interested candidates.
In all cases, it should be noted that Cocktail Team® only processes Personal Data if, inter alia:
The Holder has given express authorization for the Processing of his Personal Data for one or more specific purposes; or
Processing is necessary for the proper performance of a contract to which you are a party;
Legally required processing; or
The Processing is necessary for the realization of the legitimate interests of Cocktail Team®, except when these interests do not overlap with the interests or fundamental rights and freedoms of the Data Subject.
3.4 HOW LONG DOES COCKTAIL TEAM® KEEP YOUR PERSONAL DATA?
Cocktail Team® keeps your Personal Data in accordance with the retention periods imposed by legislation and regulations in force, namely taking into account its activities.
Cocktail Team® can store your Personal Data during the following periods:
When you contact us to request information, we keep your personal data for the time necessary to process and fulfill your request;
We keep your personal data used for direct marketing until you cancel the authorization or ask us to delete them, in accordance with the legislation in force. In that case, Cocktail Team® will only preserve the information necessary to guarantee your right of opposition in accordance with the regulations and legal rules. Personal Data relating to applicants is stored for one year after your last visit to the applicant space.
Cookies used by Cocktail Team® are stored until the user removes them from their browser.
3.5 WHO ARE THE RECIPIENTS OF YOUR PERSONAL DATA?
Cocktail Team® employees responsible for customer support management, sales and business management and Information Technologies can only access your Personal Data for strict necessity.
Likewise, only the services responsible for recruiting and managing Human Resources at Cocktail Team® will have full or partial access to Personal Data related to candidates, strictly necessary.
Cocktail Team® does not share your Personal Data with third parties, with the exception of service providers, as provided in section 5, especially for the purposes of combating fraud, managing payments, hosting, administering Information Technologies and providing customer support.
Cocktail Team® may also transmit your Personal Data to other entities of the Cocktail Team® Group and to its potential service providers for the purposes of remote access to support information systems, for accommodation, etc. which may be located outside the European Economic Area.
Cocktail Team® may transfer Personal Data to third parties in accordance with requests from public judicial authorities with legal powers for this purpose, in accordance with the legal regulations in force.
Cocktail Team® guarantees the confidentiality and security of Personal Data during transfer to the aforementioned recipients.

Nesse sentido, a Cocktail Team® compromete-se a usar cláusulas contratuais padrão (conforme emitidas pela Comissão Europeia ou por Autoridade de Supervisão competente) ou quaisquer outras medidas de protecção adequadas. Tratando-se de transmissão de Dados Pessoais para um receptor localizado fora do Espaço Económico Europeu, num país que não garanta nível adequado de protecção de acordo com a Comissão Europeia. As referidas cláusulas fornecem medidas de protecção adequadas a respeito da protecção da privacidade e direitos, liberdades e garantias de pessoas singulares em relação ao exercício dos direitos correspondentes.

5. SAFETY MEASURES
Cocktail Team® has implemented all appropriate technical and organizational measures to ensure a level of security of Personal Data appropriate to the risk and, in particular, to protect Personal Data against destruction, loss, alteration, unauthorized disclosure or accidental or illegal access.
The same level of protection is contractually imposed by Cocktail Team® to its Subcontractors.
Any Cocktail Team® employee who, during their work, may have access to their Personal Data will keep them strictly confidential.
6. EXERCISE OF YOUR RIGHTS
You may, at any time, in accordance with the applicable rules regarding the protection of Personal Data, exercise your rights of access, rectification, deletion and transfer of your Personal Data and also your rights of restriction and opposition to the Processing of your Data Personal.
You also have the right to object to the Processing of your Personal Data for direct marketing purposes and, therefore, request to stop receiving promotional communications from Cocktail Team and/or other entities of Cocktail Team®, at any time. When Processing is based on your express consent, you have the right to withdraw your consent at any time.

7. CHANGES TO OUR PERSONAL DATA PROTECTION POLICY
The Personal Data Protection Policy may be changed by Cocktail Team® at any time.
If Cocktail Team® intends to adjust the Policy (e.g. if Cocktail Team® intends to use your Personal Data in a way that is not stipulated in the Policy in force at the time of data collection), a notice of such changes will be published a revised version of the current Policy and the revised version will be effective when posted.
Cocktail Team® will publish such changes on the Personal Data Protection Policy page, informing the customer through a message when accessing the website, application or digital platforms.
